1. About these terms
These Terms of Service ("Terms") govern the supply of the Staff GP Access service ("Service") by Staff GP Access ("we", "us", "our") to a business customer ("you", "Customer"). By purchasing a plan, requesting a quote or otherwise using the Service, you agree to these Terms.
These Terms are intended for business-to-business contracts only. Nothing in these Terms affects an individual employee's statutory rights as a consumer.
2. The Service
Staff GP Access is an employee wellbeing benefit that arranges access for your eligible employees and members of their household (where supported by provider terms) to a GP support service delivered by an independent, regulated third-party healthcare service provider ("Healthcare Provider"). The Service typically includes:
- A 24/7 telephone GP helpline.
- Online video GP consultations available seven days a week between 8am and 10pm, excluding bank holidays.
- Electronic private prescriptions where clinically appropriate.
- Access to a medical information database.
The clinical service is provided by the Healthcare Provider under its own terms of business, clinical governance and complaints procedure. We act as the contracting and administration party between you and the Healthcare Provider.
3. Important — what the Service is not
The Service is not private medical insurance, is not a substitute for the NHS, and is not intended for emergency, life-threatening or urgent care. In an emergency, employees must call 999 or attend the nearest A&E. For urgent but non-emergency care, use NHS 111 or the appropriate NHS urgent care service. We do not guarantee any specific clinical outcome, diagnosis, medication, reduction in absence or recovery time.
4. Eligibility and use
- You must be a UK-registered business or organisation with authority to enter into these Terms.
- The Service is for the benefit of named employees of the Customer and members of their household, in line with the Healthcare Provider's terms.
- You must accurately confirm employee numbers and provide accurate enrolment information.
- You must not resell, sub-license or commercially exploit the Service.
5. Orders, plans and activation
When you purchase a plan online or accept a quote, a contract is formed when we issue confirmation. Activation is then arranged with the Healthcare Provider. We will contact you to confirm employee numbers and the information needed to issue access details. The Service starts on the activation date confirmed by us.
6. Fees, payment and renewals
- Fees are as quoted or shown at checkout. Online payments are processed by Stripe.
- Plans are typically billed annually in advance, unless otherwise agreed in writing.
- Prices are exclusive of VAT unless stated otherwise.
- Plans renew automatically at the end of each term unless cancelled in writing at least 30 days before the renewal date, subject to the specific terms of your plan.
- Where employee numbers change materially during a term, we may adjust pricing for the next renewal.
7. Medication and pharmacy costs
Where a Healthcare Provider GP issues a private prescription, the cost of any medication, pharmacy dispensing fees and delivery is separate and is the responsibility of the individual receiving the prescription, unless the Healthcare Provider's terms state otherwise.
8. Cancellation, refunds and changes
Because the Service involves arranging activation with a third-party Healthcare Provider, refunds are not generally available once your account has been activated. We may, at our discretion, agree pro-rata adjustments where required by law or in exceptional circumstances. Statutory rights that cannot be excluded are unaffected.
9. Customer responsibilities
- Communicating clearly with your employees about how to use the Service.
- Ensuring you have a lawful basis to share employee data with us where required.
- Keeping access details confidential and notifying us if they are misused.
- Not using the Service in any unlawful, fraudulent or harmful manner.
10. Service availability
While the telephone helpline operates 24/7 and video consultations are available within the published hours, availability is subject to the Healthcare Provider's terms and may be affected by demand, technical issues or events outside our reasonable control. We do not guarantee uninterrupted availability.
11. Intellectual property
All trademarks, content and materials on this website and within the Service are owned by us or our licensors. You are granted a limited, non-exclusive, non-transferable licence to access them for your internal business use.
12. Liability
Nothing in these Terms limits or excludes our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot lawfully be limited.
Subject to the above, and to the maximum extent permitted by law:
- We are not liable for any clinical advice, diagnosis, treatment, prescription or other clinical decision made by the Healthcare Provider or its clinicians.
- We are not liable for any indirect, special or consequential loss, loss of profits, loss of business, loss of goodwill, or loss of data.
- Our total aggregate liability arising out of or in connection with the Service in any 12-month period is limited to the fees paid by you to us in that period.
13. Data protection
Each party will comply with applicable data protection laws, including UK GDPR and the Data Protection Act 2018. Our handling of personal data is described in our Privacy Policy. The Healthcare Provider acts as an independent data controller of clinical data created when an employee uses GP services.
14. Termination
We may suspend or terminate the Service immediately if you breach these Terms, fail to pay any sums when due, or if continuing the Service would breach any law or the Healthcare Provider's terms. On termination, all rights to use the Service cease.
15. Changes to these Terms
We may update these Terms from time to time. The version in force at the start of your current term will continue to apply for that term, unless changes are required by law.
16. Governing law and jurisdiction
These Terms and any dispute arising out of or in connection with them are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction.
